Ok so i emailed blizzard about the beta. So this is what the guy said so EVERYONE DO IT!!!!
Greetings, The opt-in is basically a lottery if you are selected you will receive an email. We are currently not able to process Beta test requests through email. However we are running a Beta lottery for upcoming products, and you can choose to enter this lottery by creating a Blizzard account at our Blizzard store site at http://www.blizzard.com/store No purchase is necessary to create an account, the option to be entered into the Beta Lottery (Blizzard Beta Opt-In) is included in the Preferences area of the account signup options, along with an option to sign up for the Blizzard Insider newsletter. In addition, should we need further Beta testers for our upcoming products we will be posting an announcement on our web site, along with an application form. ...That IS the lottery. When you opt in for the Beta, you have a chance of getting in. |

When they said that you have a chance of BETA testing, they mean that they take all the computers with the system requirements, then the take a select few from that group to beta test.... and i guess that's a lottery, because getting chosen had nothing more than luck on its side.

There's a difference between the strict definition of "lottery" and gambling. Lottery just means the results or "winners" are selected at random. Gambling implies that your are investing something like money for example that could possibly be lost depending on the outcome.

In reality tho, its not strictly a "lottery" because not everyone has an equal chance. They will favor those with higher system specs, as is usually the case with betas (because betas are not fully optimized, more pc power is required to run them).
